Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Richi Kids mobile application ("App") operated by Richi Kids, Inc ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

  1. Who May Use This App
    The App is intended for use by parents or legal guardians ("Account Holders") on behalf of their children. By creating an account, you confirm that:
    • You are at least 18 years of age and are the parent or legal guardian of the child who will use the App, or
    • You are at least 16 years of age and are using the App for yourself.
    You are responsible for ensuring that your child's use of the App complies with these Terms. We do not knowingly permit children to create accounts independently.
  1. Account Registration
    To access the App, you must create an account by providing accurate and complete information, including your name and email address. You may register directly through the App or via Apple ID (Sign in with Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at help@fngrm.app if you suspect unauthorized use of your account.
  1. Free Trial and Subscription
    a) Free Trial
    We offer a free trial period for new users. The duration of the trial will be disclosed at the time of sign-up. During the trial, you will have access to all features included in the selected subscription plan. No charge will be made during the trial period.
    b) Subscription
    Plans After the free trial ends, continued access to the App requires a paid subscription. We offer the following plans:
    • Monthly Plan — $9.99 per month
    • Annual Plan — $99.00 per year (billed annually)
    • Lifetime Plan — $149.00 one-time payment
    c) Billing
    All payments are processed through the Apple App Store. Subscription fees are billed in advance. By subscribing, you authorize Apple to charge your payment method on the applicable billing cycle.
    d) Auto-Renewal
    Monthly and Annual subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings.
    e) Cancellation
    You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to the App until then. We do not offer refunds for partial billing periods, except where required by applicable law.
    f) Price Changes
    We reserve the right to change subscription prices at any time. We will provide advance notice of any price changes. Your continued use of the App after a price change constitutes your acceptance of the new price.
  1. Acceptable Use
    You agree to use the App only for its intended educational purpose and in compliance with these Terms and all applicable laws. You agree not to:
    • Use the App for any unlawful, harmful, or fraudulent purpose
    • Attempt to reverse engineer, decompile, or disassemble the App
    • Use automated tools to access or scrape the App
    • Share your account credentials with third parties
    • Upload or transmit any harmful, offensive, or infringing content
    • Interfere with or disrupt the App's servers or infrastructure
  1. Intellectual Property
    All content within the App — including but not limited to text, graphics, logos, icons, images, audio clips, game mechanics, and software — is the exclusive property of Richi Kids, Inc or its licensors and is protected by United States and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, or publicly display any content from the App without our prior written consent.
  1. Virtual Content
    The App may include virtual items, virtual currency, or other in-app content ("Virtual Content"). Virtual Content has no real-world monetary value and cannot be exchanged for real money or transferred outside the App. We reserve the right to modify, suspend, or discontinue Virtual Content at any time without liability to you.
  1. Children's Use and Parental Responsibility
    The App is designed for children to use under parental supervision. As a parent or guardian, you are solely responsible for:
    • Monitoring your child's use of the App
    • Ensuring the App is appropriate for your child's age and maturity level
    • Managing in-app purchases and subscription settings through your Apple ID We are not responsible for any content your child accesses outside the App through third-party links or services.
  1. Disclaimer of Warranties
    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
    The financial education content provided in the App is for informational and educational purposes only and does not constitute financial advice. We make no representations about the accuracy or completeness of any financial content in the App.
  1. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RICHI KIDS, INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
  1. Indemnification
    You agree to indemnify, defend, and hold harmless Richi Kids, Inc and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any applicable law or third-party rights.
  1. Third-Party Services
    The App integrates with third-party services including Apple App Store, Mixpanel, and Amplitude. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.
  1. Termination
    We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 8, 9, 10, and 13.
  1. Governing Law and Dispute Resolution
    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
  1. Apple-Specific Terms
    If you downloaded the App from the Apple App Store, the following additional terms apply:
    • These Terms are between you and Richi Kids, Inc only, not Apple Inc.
    • Apple has no obligation to provide maintenance or support services for the App.
    • In the event of any product liability claim, warranty claim, or third-party intellectual property claim relating to the App, Richi Kids, Inc — not Apple — is responsible for addressing such claims.
    • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  1. Changes to These Terms
    We may update these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the Effective Date above. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
